Our problem employee said after we fired him "what took you so long". He's right. Here's what we should have done.

Senior management has asked you whether they should dismiss a young manager. You must have a layoff memorandum sample handy. Of all your papers, the termination notice is the most important. You might also highlight useful and exceptional work the employee did, all while making clear the dismissal is not a debatable issue. So dismissing them in a traditional termination meeting can be difficult. This is critical if you decide to continue the examination further.

Who Conducts The Insubordination Examination? You meet with the worker in your office and tell him "It's just not working out." You want him to leave voluntarily. Your letter should also explain the employee's rights and responsibilities. One of the first questions many former workers ask during the exit interview involves unemployment benefits. Those procedures can compromise the privacy of the fired worker. Once you have stated your grounds for dismissing, give the details of the lay off package. These programs and unemployment compensation ensure the worker and his family won't starve as he looks for a new job. This is always a concern if the employee decides to take you to court for improper separation. This is all the proof you must layoff immediately. Then you can separate who you want whenever you want.
